A container of bath salts was seized from a Chester man at a Rock Hill motel on Monday — the same day the S.C. Department of Health and Environmental Control board issued a ban and classified them as controlled substances.

Officers noticed two men loitering in the parking lot of Executive Inn on North Anderson Road, according to a Rock Hill police report. Officers searched one of the men and found a container of white powder marked "Bath Salts" in his pants pocket. The white substance tested negative for cocaine.

The man admitted that he had snorted bath salts in the past, the report states. The container was taken into evidence, but no charges were filed.

On Monday, DHEC classified three substances commonly known as bath salts and five substances used in the production of synthetic marijuana as Schedule I controlled substances. People have ingested the bath salts as psychoactive drugs, and the U.S. Drug Enforcement Administration categorized them with the same designation on Friday.

"With the boards vote (Monday), the state's designation of these substances mirrors the federal designation," said Carl Roberts, general counsel for DHEC in a press release. "This will allow state and local law enforcement officers to deal with the issue, as it is illegal to manufacture, distribute, possess, import or export these substances. These chemicals have been found by the DEA to pose an imminent hazard to public safety and health."

The Chester man was not charged because police were not notified of the new state law until Tuesday morning.

Lt. Brad Redfearn said the police department couldn't charge federal statues. "Our agency has to wait until a state law is enacted," he said.

Under the new law, bath salts and synthetic marijuana fall under the same category as cocaine and heroin.

Now, anyone buying, selling or possessing such drugs could be charged with a felony on first offense and face a possible $5,000 fine and up to five years in prison.
